This Electronic Publications Addendum is incorporated into the Agreement if You selected and paid for electronic publications font rights in the Order Invoice, and provides additional rights for the License by allowing You to use the Fonts in one or more electronic publications ("Electronic Publication" or "EPUB") only. We grant You under the License the additional rights stated in this addendum. For clarification, an EPUB is a title that embeds the Fonts for the purposes of providing the display of text and graphics on e-book or e-reader type devices. Such uses include embedding the Fonts in the pdf, mobi, txt, html, epub, or iBooks formats.
a. Per-Title License. The License under this Addendum is restricted to the number of EPUBs specified in the Order Invoice. Each distinct EPUB title requires a separate license. Format variants of the same EPUB title (e.g., EPUB, MOBI, PDF) are considered a single title for licensing purposes and do not require separate licenses. A revised or new edition of an EPUB published under a new ISBN requires a new license. A bundle or collection comprising two or more EPUB titles is considered a new title and requires a new license.
b. Obfuscation Requirement. Prior to distributing any EPUB, You must use commercially reasonable efforts to apply font obfuscation to all embedded Fonts in accordance with the EPUB specification or an equivalent method. If Your toolchain does not support font obfuscation, You must notify Us in writing prior to distribution and obtain Our written approval of an alternative protection method before proceeding. Regardless of the obfuscation method used, You represent and warrant that You will not knowingly distribute any EPUB in a manner that makes the embedded Fonts accessible for extraction, copying, or independent use by the end user or any third party.
c. Editable Use. The use of the Fonts for static, dynamic, or editable text in the EPUB is permitted. However, providing the ability for a user of the EPUB to edit text using the Fonts is not allowed if the result is a new document such as a personalized invitation or greeting card, customized product, or any other material for use outside of the EPUB. You shall not use the Fonts as a tool or resource for third parties to create customized products, documents, or other material.
d. Embedding Only. Fonts may only be embedded in the EPUB. You are not permitted to transmit copies of the Fonts to third parties outside of the EPUB.
e. Third-Party Use. This License does not extend to third parties. If You are using the Fonts for the creation of an EPUB for a third party, You or the third party must purchase appropriate licenses to cover their use of the Fonts. You are responsible for any liability arising from Your inclusion of Fonts in EPUBs not owned by You.
